CONTEST DESCRIPTION AND PARTICIPATION: 

Contest Start Date: “Scandinave Spa Blue Mountain Date Night Giveaway” (the “Giveaway”) will open for entries on Thursday, January 30, 2025, and prizes will be awarded on Friday, February 7, 2025, at 2:00 pm EST.

Contest Closing Date: The deadline for entering the Contest is Thursday, February 6 at 11:59 pm EST.

Sponsor: The Contest Sponsor is Scandinave Spa Blue Mountain. By entering the Giveaway, entrants accept and agree to be bound by these Rules and Regulations and accept the decisions of Scandinave Spa Blue Mountain and its agents as final and binding in all respects.

GENERAL

ELIGIBILITY: 

No purchase necessary. The giveaway is open to residents of Canada (excluding residents of Quebec) who are nineteen (19) years of age or older at the time of entry.  Proof of age and place of residence may be required.  This Giveaway is not open to employees of Scandinave Spa Blue Mountain its officers or employees, the sponsors and prize suppliers (“Promotional Parties”), its advertising and promotion agencies and their shareholders, directors, officers, and employees nor any person who resides with any of these individuals. This Giveaway is void outside the jurisdiction listed above and where prohibited by law. The Giveaway is subject to all applicable federal, provincial, and municipal laws and regulations.

ENTRY: 

To participate in the Giveaway, participants must visit the contest posted on Scandinave Spa Blue Mountain’s webpage to complete and submit an entry. All entries will be reviewed by Scandinave Spa Blue Mountain or its agent for eligibility. Entrants may only enter the giveaway once during the entire promotional period. Entrants can earn more chances to win by subscribing to the e-newsletter and sharing on Facebook.  In the event it is discovered that a participant attempted to enter the Giveaway more than once, all the participant’s entries will be voided. All entries must be received by the Giveaway closing date.

DRAW: 

There is one (1) prize available to be won. The prize will be awarded by 2:00 pm EST on the following schedule:

Friday Feb 7, 2025: 1 prize to be awarded

Scandinave Spa Blue Mountain or their designated affiliate will randomly select the winner to win the correlating prizes for that day. The winning entry will be awarded the prize, provided the entry is valid and meets all criteria outlined in the Rules and Regulations. No cash alternative will be made available.  If a person wins a prize, they are not eligible to win additional prizes.

WINNER: 

The selected winner will be contacted via the provided email address by 2:00 pm EST by Scandinave Spa Blue Mountain or their designated affiliated agent. The participant who is drawn at random will be required to correctly answer a skill-testing mathematical question within a specified time. If the candidate responds incorrectly to this question, his/her entry will be rejected.  If the winner is not reached on the first call, Scandinave Spa Blue Mountain or their agent will contact the winner for three (3) consecutive business days after the draw (dates outlined below). If the winner still cannot be contacted by 2:00 pm on the third business day, the prize will then be forfeited.

Winner announcement schedule:

If a selected entrant cannot be contacted for any reason by the specified times or is unwilling to accept the prize or unable to comply with the requirements as set out by the Giveaway Rules and Regulations, the Giveaway Sponsor shall have the right to disqualify that participant.  By entering the Giveaway, you agree that if you are a selected winner that is disqualified and the prize is forfeited for any reason, the Giveaway Sponsor, agent, and Promotional Parties shall be fully and completely released and discharged from any liability or responsibility in this regard. By entering the Contest, the winner consents to the use of his or her name, image, voice, likeness, city of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Giveaway Sponsor, and Promotional Parties and/or its advertising or promotional agencies without limitation or further notification or compensation.

PRIZE:

One (1) contest entrant will be randomly drawn on Friday, February 7, 2025 to win one (1) Overnight Getaway Package including 1 x one (1) night stay at a local hotel for 2 guests ($250 value), a Scandinave Spa Blue Mountain Duo Massage treatment and access to the Thermal Journey experience for 2 guests ($466) , plus a Spa Boutique Package for 2 (total Spa prize value $838) Some terms & conditions apply. There is no cash alternative.

Prize details:

Total Prizing Value = $1088.00

The prize must be accepted on an ‘as is’ basis. No substitution, assignment, redemption for cash, or transfer of any part of the prize is permitted except that the Giveaway Sponsor and Promotional Parties, in their sole discretion and subject to applicable law, reserve the right to substitute a prize or any portion thereof with something of equal or greater value.

The Giveaway Sponsor reserves the right, in its sole discretion to terminate or suspend the Giveaway or modify the Giveaway Rules and Regulations at any time. The prize may not be sold, transferred, or assigned, and is not convertible to cash. The Prize cannot be used in conjunction with any other promotion or offer. Other restrictions may apply.

ODDS: 

The odds of being randomly selected to win a Prize depend on the total number of eligible entries received during the duration of the Contest Period.

LIMITATION OF LIABILITY AND RELEASE: 

Release: Giveaway Winner(s) shall be required to sign the Sponsor’s Affidavit of Eligibility, Publicity Release and Liability Waiver (in the form used as of the date of Giveaway entry, a copy of which may be obtained upon written request to the Sponsor) as a condition of being awarded the Prize. Individuals gifted the second prize shall also be required to sign the Sponsor’s Affidavit of Eligibility, Publicity Release and Liability Waiver (in the form used as of the date of Giveaway entry, a copy of which may be obtained upon written request to the Sponsor) as a condition of being chosen as the second Giveaway Winner when he or she collects or uses his or her Prize. The Affidavit of Eligibility, Publicity Release and Liability Waiver will confirm that the Giveaway Winner(s) and Guest(s) comply with these Rules and Regulations and meet the eligibility requirements, that they accept the Prize and release and hold harmless Scandinave Spa Blue Mountain, its elected officials, officers, directors, and employees, its affiliated sponsors and prize suppliers, its advertising and promotion agencies, the Giveaway organizers, and their shareholders, officers, directors and employees, with respect to any injury, accident, loss or death related to any aspect of the Giveaway, the Prize and its use. After being contacted regarding the release and waiver by Scandinave Spa Blue Mountain or its agent, the Winner(s) and the person they have gifted their second prize to will have up to three (3) business days after they have been sent the release and waiver to return the duly executed release form, submitting it by email or mail, to Scandinave Spa Blue Mountain at either an email address provided to the winner or 152 Grey Road 21, Blue Mountains, Ontario L9Y 0K8. Failing to do so will result in another participant being drawn at random and the original Winner and the person they have gifted their second prize to shall forfeit their claim to the prize and shall have no recourse against Scandinave Spa Blue Mountain or its agents, contest sponsors or promotional parties.

Exclusion of Liability: Scandinave Spa Blue Mountain, its elected officials, officers, directors, and employees, its affiliated sponsors and prize suppliers, its advertising and promotion agencies, the Giveaway organizers, and their shareholders, officers, directors, and employees, cannot be held responsible for any material, physical or emotional damage that can be linked in any way to the Prize awarded as part of the Giveaway.

False Identity:  The entry of any person using an assumed name, alias, or false identity to participate in the Giveaway will be deemed null and void and, as such, may be disregarded by Scandinave Spa Blue Mountain. Incomplete entries and entries made with multiple addresses, under multiple identities, or using any device or artifice to enter multiple times will be automatically void.

Errors: Scandinave Spa Blue Mountain cannot be held responsible for any errors, incorrect or inaccurate transcription, or registration of Giveaway entry information, nor for technical difficulties due to a server, network, hardware or software failure, a transmission problem or a loss of data or documents sent by participants. If a participant is randomly chosen during the draw due to a system error, malfunction or defect, the Prize at issue may be withdrawn and re-awarded to another participant.

Personal Information: Subject to the aforementioned, personal information gathered in the context of the Giveaway will not be used by Scandinave Spa Blue Mountain except for the purpose of administering and conducting the Giveaway, and for no other purpose without consent, unless the person chooses to opt-in to receive further communication. In supplying this information, participants consent to Scandinave Spa Blue Mountain’s use of all such information for the purposes indicated above.

TAXES: 

If applicable, the Winner is responsible for reporting any taxable benefits because of winning this Giveaway to relevant tax authorities.

LEGAL COMPLIANCE: 

This Giveaway is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial, and municipal laws and regulations.

PRIVACY POLICY: 

The Giveaway Sponsor is collecting personal information about entrants for the sole purpose of administering this contest, unless otherwise provided for by the Giveaway Rules and Regulations. The entrant’s personal phone number and email will be used for the sole purpose of contacting the winner, unless the entrant opts in to receive further future communication from the Giveaway Sponsor. The winner’s personal information will be used in accordance with the contest Rules and Regulations.
